TERMS & CONDITIONS
The following Terms and Conditions apply to all session agreements made between Rhonda Draper Sound Education (RDSE) and its musicians, and the parents/caregivers of “the musician” (meaning the student).
This document also includes references to Bring The Noise (BTN), the music school within which RDSE delivers music education for children.
The Terms and Conditions described below may seem strict, but they have been designed to be as fair as possible for both clients and providers. As RDSE is a social enterprise operating with minimal margins, these policies are in place to ensure sustainability and to protect RDSE from financial losses caused by non-payment for services rendered.
RDSE approaches each individual case in good faith and expects the same in return. Some policies may favour RDSE, while others may favour the parent/caregiver and musician.
1. TERM DATES
1a. Session weeks at BTN generally align with the British Columbia educational school terms; however, there may be occasional differences. BTN will provide these dates well in advance.
1b. It is the responsibility of the musician and caregivers to be aware of the first and last dates of the academic year at BTN.
2. COMMUNICATIONS
2a. All correspondence can be sent to musicians/caregivers via email or phone.

2b. It is the responsibility of musicians/caregivers to inform RDSE of any changes to their contact details. RDSE will not be held responsible for missed communications, overdue payments, or missed sessions due to incorrect contact information.
3. TIMETABLING OF SESSIONS
3a. Musicians/caregivers will be informed of session days, times, and start dates on the RDSE webpage:

RDSE may also confirm session details by email but does not guarantee this if sufficient confirmation has been provided by other means.
3b. If session times or days need to be changed, RDSE will notify musicians/caregivers as far in advance as possible.
4. ATTENDANCE & ABSENCES
Session times are standing appointments. A musician’s session time is reserved for them and their group each week, and it is their responsibility to attend. Parents/guardians should commit to a session time that suits their schedule.
Tuition covers more than just the time spent in a session, even if a musician misses a scheduled class.
4a. Music Classes / 6-Week Modules
4a.i. No make-up sessions or credits will be provided for individual absences from group sessions at RDSE, regardless of notice given.
4a.ii. If RDSE is unable to run a session due to illness or unforeseen circumstances, RDSE will arrange for either a substitute coach or a rescheduled session. Due to full teaching schedules, make-up sessions may take time to coordinate. Families will be notified as soon as rescheduled dates become available.
4a.iii. Tuition is charged for the entire module. No refunds or credits will be issued for missed or cancelled lessons.
4b. Credit for Missed Sessions
4b.i. Customer credit may be granted at the discretion of RDSE and BTN management for missed sessions but has no cash value and is non-transferable.
4b.ii. If RDSE cancels sessions due to unforeseen circumstances, customer credit may be granted at RDSE/BTN management’s discretion.
4c. Extended Medical Absence
If a musician is absent for more than three consecutive weeks due to medical reasons, a credit may be granted at the discretion of RDSE/BTN management.
4d. Statutory Holidays
4d.i. If a scheduled lesson falls on a statutory holiday, that lesson will not be rescheduled, credited, or refunded.
4d.ii. Tuition secures a standing appointment throughout the year and factors in these occasions.
5. DURATION OF THE SESSION AGREEMENT
5a. The session agreement between RDSE and the musician is ongoing and continues into each 6-week module or month.
5b. Musicians are billed at the beginning of each 6-week module or series of music classes (see Section 7).
6. CANCELLING THE SESSION AGREEMENT
6a. Musicians wishing to cancel their session agreement must provide formal written notice to RDSE management at least two weeks before their intended last session. It is recommended that musicians complete the term before cancelling.
6b. Verbal notice given to a coach is not considered sufficient and must be confirmed in writing to rbdraper@shaw.ca.
6c. Exceptions on medical grounds may be made at the discretion of RDSE management.
6d. No refunds or credits will be given for cancellations made during a fixed-length program.
6e. If RDSE cancels a session agreement, RDSE will endeavour to provide two weeks’ notice. Any prepaid sessions beyond the cancellation date will be credited to the musician’s account.
6f. If RDSE cancels a session agreement due to property damage or harassment of staff by the musician, cancellation may occur without notice, and no credit or refund will be provided.
7. PAYMENTS
7a. RDSE operates by e-transfer. Payment must be made before the first class of each 6-week module or series of music classes.
7b. If e-transfer is not possible, cash payments must be made in person at the first class of the module or series. This ensures predictable billing for families and secures each musician’s placement in BTN programs throughout the year.
8. PENALTIES
8a. Overdue accounts will incur a $25 penalty after 28 days, with an additional $15 penalty for every subsequent 14-day period.
8b. RDSE reserves the right to suspend musicians from sessions if fees remain unpaid.
8c. Accounts overdue by 30 days may be referred to a debt collection agency, with all associated costs added to the outstanding balance.
9. PHOTOGRAPHY & FILMING
9a. RDSE may use photographs or video footage of musicians for promotional purposes.
9b. Written notice must be provided if a musician does not consent to the use of their image.
10. CHANGES TO TERMS & CONDITIONS
10a. RDSE reserves the right to update these Terms and Conditions at any time without prior notice. The most current version will always be available on Rhonda Draper’s webpage on the BTN website.
